REGULATION NO. 2002/1

AMENDING UNMIK REGULATION NO. 2001/20 ON THE PROTECTION OF INJURED PARTIES AND WITNESSES IN CRIMINAL PROCEEDINGS

 

The Special Representative of the Secretary-General,

Pursuant to the authority given to him under United Nations Security Council resolution 1244 (1999) of 10 June 1999, .

Taking into account United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 1999/1 of 25 July 1999, as amended, on the Authority of the Interim Administration in Kosovo and UNMIK Regulation No. 1999/24 of 12 December 1999 on the Law Applicable in Kosovo,

Having promulgated UNMIK Regulation No. 2001/20 of 20 September 2001 on the Protection of Injured Parties and Witnesses in Criminal Proceedings,

Recognizing that the intimidation of injured parties and witnesses severely undermines efforts to effectively investigate and prosecute serious crimes in Kosovo, including inter- ethnic crimes and organized crime, and constitutes a significant obstacle to the establishment of rule of law in Kosovo,

Hereby amends section 8 of UNMIK Regulation No. 2001/20 with a view to revising and clarifying the scope of application of the regulation:

 

Section 1

Amendment

 

Section 8 of UNMIK Regulation No. 2001/20 shall have the following wording as of the date on which the present regulation enters into force:

The present regulation shall also apply to criminal proceedings initiated between 10 June 1999 and the date of the present regulation.

 

Section 2

Entry into Force

 

The present regulation shall enter into force on 24 January 2002.
