State of emergency

This subsection contains international standards which set out key principles to be observed by the State when derogating from its human rights obligations in time of emergency and stipulate which rights may not be subject to derogation under any circumstances. It also includes examples of constitutional provisions and national legislation addressing such issues as declaration of the state of emergency and its implications for human rights.
